September 2008: Errors within Annex II of MRLS The EU have published amendments to errors in information and MRLS within Annex II of the recently published annexes of Regulation 396/2005 (Community regime for setting and controlling Maximum Residue Levels (MRLs) in food and feeding stuffs). These errors include quoted MRLs. The PSD have compared the MRLs set with those needed to identify the uses at risk. The PSD has published this list of revocated uses which took effect from 1st September. A period of six months has been allowed for the amendment of product labels to remove references to the on-label uses concerned. Also on-label approvals for fluazifop-p-butyl on onion, carrot, peas and linseed which were previously revoked in error and have been re-instated. The list can be accessed from the PSD web-site using the link below http://www.pesticides.gov.uk/food_safety.asp?id=2515 September 2008: Amendment to Maximum Residue Levels in food and feedingstuff EC Regulation 396/2005 established a Community regime for setting and controlling Maximum Residue Levels (MRLs) in food and feeding stuffs. The Regulation becomes fully applicable on the 2nd September 2008 (when national MRL of each Member State for each pesticide/crop combination for operators to comply with in national legislation will cease) EC Regulation 149/2008 established Annexes II, III, IV into Regulation 396/2005. Annex II of the regulation fixes maximum levels (MRLs) already provided for under Council Directive 86/362/EEC for pesticide residues in and on cereals, Directive 86/363/EEC for pesticide residues in and on foodstuffs of animal origin and Directive 90/642/EEC for pesticide residues in and on certain products of plant origin, including fruit and vegetables. Annex III establishes temporary MRLs for active substances for which a decision has not been taken on inclusion in Annex I of Directive 91/414/EEC and MRLs for new agricultural products for which no MRLs were set in the original directives for each type of product. Annex III - part A (all draft Temporary MRLs that were thus far not harmonised at EU level) Annex III - part B (all draft Temporary MRLs of active substances harmonised at EU level in and on new commodities) Annex IV contains a list of active substances of plant protection evaluated under Directive 91/414/EEC for which no MRLs are required. The revised limits will apply from 6 April 2008. http://eur-lex.europa.eu/LexUriServ/site/en/oj/2007/l_260/l_26020071005en00040012.pdf Withdrawal of Authorisation for methomyl Information provided to EFSA indicates that there is a high risk of ecotoxicology for birds, mammals, aquatic organisms, bees and non-target arthropods plus there is information that the acceptable operator exposure level would be exceeded and bystanders would be exposed to higher than acceptable levels. Because of these factors the decision has been taken that methomyl should not be included in the Annex of permitted active substances and all authorisations for plant protection products containing methomyl should be withdrawn by 19 March 2008. Withdrawal of Authorisation for trifluralin Information provided to EFSA indicates that trifluralin is highly toxic to aquatic organisms in particular fish. It is also highly persistent in soil, not readily biodegradable and has potential for bioaccumulation. Because of these factors the decision has been taken that trifluralin should not be included in the Annex of permitted active substances and all authorisations for plant protection products containing trifluralin should be withdrawn by 20 March 2008. Any period of grace, to allow for products to be sold through and used in one further growing season, should expire at the latest on 20 March 2009.
